These Terms of Use (“Terms”) govern your use of services offered by PERKS CIRCLE LTD. DBA PERK BUDDY. These Terms apply to the Perk Buddy website at www.perkbuddy.ca and all other sites, mobile sites, services, applications, platforms, and tools where these Terms & Conditions appear or are linked (collectively, the "Site"). As used in these Terms & Conditions, "Perk Buddy", "us", or "we" refers to Perk Buddy and its affiliates.
Please read these Terms of Use carefully before using the Service offered by Perk Buddy. BY USING THE SERVICE IN ANY WAY, YOU AGREE TO BE BOUND BY THESE TERMS OF SERVICE.
We retain the right to modify or revise these Terms of Service at any time, with or without prior notice. We recommend that you periodically review the latest version of these Terms of Service. By choosing to continue using the Service after any changes have been posted to these Terms of Service (or the Privacy Policy), you indicate your acceptance of those modifications. Additionally, you acknowledge that, while using the Service, you are subject to any posted guidelines or rules, including new guidelines or rules that may be periodically added. It is important to understand and agree that the Service is provided on an "AS-IS" basis, and we assume no responsibility of any kind. All such guidelines or rules are hereby integrated into these Terms of Service.
Any individual or entity engaging with the Site through the utilization of crawlers, robots, browsers, data mining or extraction tools, or any other functionality—regardless of whether this functionality is installed or deployed by the individual or entity themselves, or by a third party—is deemed to be actively using the Site.
All content included on the site is owned and governed by Perk Buddy and its affiliates and is protected by copyright, trademark, patent, or other proprietary rights. The “Content” includes; text, graphics, logos, images, audio clips, video, data, music, software, application updates, and other material (collectively "Content"). Perk Buddy along with its suppliers and licensors, including Perk Buddy Partners, explicitly retains all intellectual property rights associated with the Content.
Signing up for Perk Buddy does not require any registration fee. To partake, you must be aged 19 or older. If you are below the age of majority in your state, province, or territory, obtaining consent from your parent or legal guardian is mandatory, as per jurisdictional requirements. Program membership is exclusive to individuals and is not extended to corporations, businesses, charities, partnerships, enterprises, or any entity other than an individual unless written approval is granted.
To participate, you will have to set up a Perk Buddy account that’ll require your first name, last name, and email address. In order to create an Account online, visit www.perkbuddy.ca or visit participating vendor websites. The methods for participating in the Program may change periodically. All the offers can be viewed once you log in to your account and visit partner stores.
When you make a purchase at any of our partner stores, you are eligible to earn and redeem Perk Buddy points. All Perk Buddy points earned in connection to a purchase made on our partner stores will be rewarded to the primary account holder. Eligible purchases and transactions may change from time to time and may vary for each partner store. Changes are not subject to any prior notice.
Redemption of Perk Buddy points is also subject to store owner's discretion. Redemptions may not apply to all products and services offered by the partner brands. Partners have the authority to refute any redemption that may not fall within the deals offered to the customers. Any change in redemption value is not subject to any prior notice. If a member wishes to discontinue their account all the points will have to be redeemed before the closure of the account.
The availability of products on the Site is subject to change without notice. The price of the product will be as shown on the partner website where you place your order. Perk Buddy reserves the right to revoke any stated offer and to correct any error, inaccuracy, or omission (including after an order has been submitted). We do not offer a price match. Promotional codes can only be applied during purchase. Perk Buddy will be unable to honor any post-order promotional code adjustments.
Certain behaviors constitute improper use of the Site. Perk Buddy reserves the right, at its sole discretion, to cancel any rewards for any reason. You agree that you will not use an invalid or unauthorized credit or debit card or other payment methods. You are solely responsible for identifying and selecting the product or service you wish to purchase. Your payment may be charged to the credit or debit card or other payment methods you use through our partners’ third-party service providers. By submitting your credit or debit card information through a partner store, you expressly consent to the sharing of this information with any relevant payment partners. We do not save your credit card information on our servers. We reserve the right, at our full discretion, to reject any and all actions. We may, in our sole discretion, limit or cancel loyalty points earned per person, per household, or per order. These restrictions may include points earned by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel any points, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided. We reserve the right to limit or prohibit rewards that, in our sole discretion, appear to be placed by scammers, competitors, or criminals. You agree to provide current, complete, and accurate information in connection with all purchases made. You agree to promptly update your account and other information, including without limitation your e-mail address and credit card information so that we may contact you as needed. By submitting your shipping address, you expressly consent to the sharing of this information with any delivery partners. Any outbound and inbound shipping charges collected on an order will not be refunded. Perk Buddy is not responsible for the shipping costs of return orders or return refunds. Refunds for returns may be processed by our partners upon examination of returned goods for seals, tampering, and condition. If the items returned are damaged or altered in any form, they will be disqualified for a refund.
The Site may contain links to third-party websites (“Other Sites” or “Manufacturers”) that are not under our control. Perk Buddy makes no claim and accepts no responsibility regarding the quality, nature, or reliability of the Other Sites that may be accessible by hyperlinks from the Site or link to the Site. We provide these links to you as a convenience, and the inclusion of any link does not imply endorsement by us of Other Sites or any association with the operators of such Other Sites. You are responsible for viewing and abiding by the privacy statements and terms of use posted at any third-party sites. You agree that Perk Buddy does not assume responsibility for any products, content, services, websites, offers, or information that is provided by third parties and made available through the Service, nor does Perk Buddy assume responsibility for your interactions with any Third-Party Provider. If you purchase, use, or access any such products, content, services, advertisements, offers, or information through us or you engage with any partner store, you agree that you do so at your own risk and that Perk Buddy will have no liability based on such purchase, use, access, or engagement.
Our Privacy Policy outlines the procedures for handling the information you furnish to us when utilizing our Services. By accessing, using, and providing information to or through the Services, you acknowledge that you have reviewed and accepted our Privacy Policy. Additionally, you consent to all actions taken by us concerning your information, adhering to the then-current version of our Privacy Policy.
Perk Buddy is a voluntary loyalty program. By joining Perk Buddy, you receive:

The reward itself may also differ for certain products, depending on the partner. Perk Buddy is not responsible for the terms or fulfillment of the offer, nor is it accountable for the partner's products or services.
As a Perk Buddy member, to access, earn, and redeem Perk Buddy benefits, it is necessary to provide your first and last name along with a valid email address when signing up for a Perk Buddy account. Additionally, to receive birthday rewards, you must also provide your birthday details (month and day) in your Perk Buddy account.
To accumulate Perk Buddy Earnings rewards, it is imperative to make purchases at Perk Buddy partner stores. This can be achieved by logging in to your Perk Buddy account and selecting the partner store to shop from or by entering your email address at the partner’s website (assuming you have previously enrolled as a member by providing your first and last name, along with a valid email address, as outlined above, and have included a valid mobile telephone number in your Perk Buddy account).
Perk Buddy points can only be accumulated and redeemed on purchases made on the partner websites/stores and no other brand.
If at any point, you no longer desire to be a part of the Perk Buddy community, you can opt out of our program without any repercussions. It's important to be aware that opting out will result in the nullification of any accumulated Perk Buddy points and rewards, potentially leading to a loss of associated program benefits. Furthermore, if you decide to re-join Perk Buddy at a later time, any previously deleted points or rewards will not be reinstated.
If you opt to have Perk Buddy delete your Personal Information, your entire Perk Buddy account, inclusive of points and rewards, will be removed. Consequently, you will no longer receive Perk Buddy benefits, as you will not be identified as a Perk Buddy member.
Perk Buddy members have the opportunity to redeem offers for products or services at select partners. While the partner's offer is accessible through Perk Buddy, it's essential to note that Perk Buddy is not responsible for the terms or fulfillment of the offer, nor is it accountable for the partner's products or services. Under no circumstances will Perk Buddy be held liable pursuant to or in connection with this Agreement, employing any legal or equitable theory, be it breach of contract, tort (including negligence), strict liability, or otherwise, for any:

In no case shall Perk Buddy, our directors, officers, employees, affiliates, partners, agents, contractors, suppliers, service providers, or licensors (collectively “Releasees”) be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. You are waiving the right to sue or claim compensation following an accident, which you or your heirs, next of kin, executors, administrators, and assigns may have against the Releasees. You hereby agree to waive any and all claims that you have or may have in the future against Perk Buddy and to release the Releasees from any and all liability for any loss, damage, injury, or expense you may suffer, or any persons exposed to products that you have purchased from us may suffer, due to any cause whatsoever, including negligence, breach of contract, breach of any statutory or other duty of care. You agree to indemnify and hold harmless Perk Buddy and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees, from any and all liability, claim, or demand, for any damage to property or personal injury to yourself or a third party, including attorneys’ fees, made by any third party due to or arising out of your breach of these Terms or the documents they incorporate by reference or your violation of any law or the rights of a third party.
In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
Your ability to access the Site remains in effect until terminated in accordance with these terms. You agree that Perk Buddy, in its sole discretion, reserves the right to terminate your use if we believe you have violated or acted inconsistently with these terms or for any other reason. The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms are effective upon your use and unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Service and when you cease using our Site. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms, we also may terminate this agreement at any time without notice, and you will remain liable for all amounts due up to and including the date of termination, and/or accordingly, may deny you access to our Service.
Our Terms of Use and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Ontario, Canada.
We reserve the right to make real-time updates and modifications to these Terms without prior notice. Should any provision of these Terms be deemed invalid or unenforceable, the provision will be restricted or eliminated to the necessary minimum, while the remaining provisions will remain fully effective. Perk Buddy's failure to enforce any rights or provisions outlined in these Terms will not be construed as a waiver of such rights or provisions. Our failure to take action against any violation of this agreement, whether by you or others, does not constitute a waiver and does not limit our rights in the case of any subsequent breaches. We explicitly retain the right to assign this agreement and delegate any associated obligations. You consent to being identified as a customer on our website and marketing materials.
